“You”, “Client”, “Yourself”, and “Your” refers to you, the person using and accessing this website and accepting the terms and conditions set out by Us. “Company”, “Tactile Websites”, “Arcridge”, “TW” “Ourselves”, “We”, “Our” and “Us”, refers to Tactile Websites a trading style of Arcridge Ltd which is a company registered in England with registered company number of 09996526. “Contract” refers to the 12 month rolling contract signed by the client.

Our website is used for general information and promotion. It is subject to change without notice and the service we offer you may not reflect the services promoted on our website. This allows us to be flexible and customise what we offer each client individually.

We’re not liable for information on our website and you must not reuse any of our content without permission. Even then we are not liable in the way you use it or it’s accuracy. Our websites contain material which is owned by or licensed to us reproduction without permission is prohibited.
Unauthorised use of this or using it in a way that it should not be used, which includes any attempt on security breach, hacks or attacks may give rise to a claim for damages and/or be a criminal offence.
Our websites may also include links to other websites. We have no responsibility for the content of any linked website(s) unless they are owned by us. By us promoting any other website, service, product or company that is not ours does not signify that we endorse the website(s), service, companies or products.
In using our site and services it is your responsibility to ensure it is what you require.

We are a service provider, we use third party providers for some of the services we offer and by using our services you understand that we’re not liable for any losses or damages which includes, without limitation, direct loss, loss of business, loss of any profits or money what so ever (whether or not the loss was foreseeable or not by either party), damage caused to your computer, any device, computer software or hardware, any systems and programs you may use, any loss of data, technical information customer data or any other direct or indirect, consequential and incidental damages. We are not liable for any damages what so ever caused by security issues which includes any hacks or website attacks. Further more we’re also not liable for any compliance failings of the site or services we provide for you, these include but are not limited to not being PCI complaint, not ensuring that the site is up to any regulatory guideline standards such as ASA, FCA, ICO, OFGEM or any other regulatory bodies. The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.

Fraud, Scams, or illegal activity

If your site is used for any fraud, scams or any other illegal activity we may remove the website with immediate effect.

You will not receive a refund for any money paid, we may report you and website to the appropriate authorities.

If your site is illegally hacked and used to perform anything fraudulent and following an investigation we decide that this was not a fault of yours we may reactivate your website after a security update and password changes.

If you wish to raise a complaint about abuse you have received (phishing scams, spam emails etc), please contact us at [email protected] detailing the abuse.

Complaints

If you wish to make a complaint about a service you have received, please send an email to [email protected] detailing the complaint. We aim to resolve all complaints within 7 working days however more complicated complaints may take longer.

Terms and conditions specific to certain services

For social media management, PR, Admin or any other service where we may communicate or have any interaction with your customers we are not liable for any loss of business, profits, or damages done to your company or brand through any interaction with your customers.

This includes any written content that they may read, such as blogs, articles or advertisement. You are required to check all material we create for you and tell us if any needs to be removed.

PC support; There are particular terms and conditions relating to PC, Laptop or any hardware/software support. These are provided separately and you must read them before agreeing to that service.

Domains
We offer one domain name free for each client, which we do however reserve the right to apply a charge if required. The price will vary depending on the chosen domain name..
Upon termination of this contract and service to you we will transfer any domain names relating to you. There is a small administrative fee of £55 + VAT per domain. You must write to us stating you want the domains transferring to you at the end of your contract. Should you not request this then we will allow your domain to expire. We are not liable for any domains which have expired.

30 Day full refund Guarantee period
We know that sometimes people buy things and change their mind. So we offer a 30 day full refund period.

How this works is simple, if we haven’t started designing anything for you then you get a full refund. If we’ve started the design work no refund is due and you may be liable to any cancelation fees.

Cookies
We use cookie technology across our sites. It places cookies on any device such as your PC, Laptop or other devices to allow us provide a better service to you.

We use Google Analytics, you can find out more about their tracking and cookies by googling them. We also use other third party analytical providers and may add some of our own

Changes To These Terms
The Company reserves the right to change these conditions from time to time without any notification. To continue to use our site signifies your acceptance of any new terms. You’re responsible for checking any terms and conditions on our website while using it. This is the same with any service we provide.

Content of your site
By using our service you are confirming that you are responsible for the content of the website we create for you or any other service used through us. We may produce the content however you are responsible to check and ensure it is legal and correct. We are not liable for any content what so ever. We recommend you get any content checked by an appropriate compliance agency if you are unsure about anything. Content can consist of audio, video, text, images and software. You must make sure that you are legally allowed to publish the content on your website and it is not infringing any copyright or trade mark laws. If you are found to be breaking any laws with the content published on your website you are entirely responsible for any consequences or legal action taken as a result of such content.

Payment
Each of our services may require a different payment method, schedule amount or timings. For our monthly websites you will be required to pay on a monthly recurring basis. This payment is required upfront for each monthly period. You will be billed on the same day each month, or earlier if required. For example if your initial payment is on the 31^st however the following month only has 30 days you will be billed on the 30^th. Payments will commence immediately.

 

Failed Payments

If your monthly payment fails for any reason we may attempt it again for up to 30 days.

If payment is not collected within 14 days after the missed payment we may cancel your service and terminate this contract. Any data, the website, stored customers, content, website code and linked services, data or information may be deleted.

We may pause the website and put up a holding page immediately after the failed payment.

If we have to terminate your contract you may be liable for cancelation fees.

Term of service

We provide a rolling 12 month contract service for the hiring of pay monthly websites. The 12 month contract is paid monthly however you might also have the option to pay quarterly, annually or 6 monthly. The same cancellation and failed payment terms apply to all.

Cancelations and termination of contract

If cancel this contract or we terminate the contract for any reason within the first 12 months you will be liable to pay an £99 early cancelation fee. This is to cover our costs of design, hosting and any other service we provide. There may be additional costs such as domain transfer costs.

When the contract is cancelled or terminated all website code and data will be deleted. We recommend making a backup of all customer data and or content if you need it.

For the first 12 months the designs and website is owned by us so this will not be transferred to you. You can not use the designs again until the full 12 months has been paid. You can pay the full 12 months up if you want to buy the designs.

After 12 months you can reuse the design however we will not transfer the website code.

If for any reason there are any issues which causes a mass loss of data, the website, content, design or any other code which is not a result of anything you have done we may cancel the contract without the termination fee.

At any point and for any reason we may cancel this contract and the services we provide. If this is not due to you breaking this contract then we may not charge a fee and we may allow you to keep the design work and any code, data or content.

Hosting
We use third party providers to host your website. Dependent on your site traffic we may have to move your site at any moment.

Design and development
Some times website coding and development just goes wrong. This could be anything from a mistake in code line to a new browser coming out. While we aim to always keep everything running smoothly sometimes things do happen.

We’re not liable for any down time or issues with your site. We will however aim to fix this as soon as possible.

Fair Usage Policy

Anyone using any of our support services must adhere to our “fair usage” policy. Under this policy, if at any time, at our sole discretion, a subscriber is found to be exceeding the level of use reasonably expected from a Subscription based Plan, then we reserve the right to terminate services we provide or charge extra for more services. We allocate 1 hour of support per client per month however we are not strict with this and understand some months you may need 2 hours while the following month you might not need any.
Changes to Your Website

Should you require any changes to your website you may request changes at any time. While further design changes are not included in any additional free support once the website is live, you can pay for more design work.

Additional functionality may be charged separately, or your monthly payment amount may increase. You will be pre-warned about any additional charges

We reserve the right to refuse to make such changes at our sole discretion.
Site Setup and time frames

Once you’ve setup the recurring payment we will make a start. Firstly we’ll send you a design form questionnaire. This is to ask general questions about what design you’d like.

During this period you can cancel and get a full refund without paying any fee. Once we’ve got this back we will start the design work.

We aim to have initial design concepts within 5 days of receiving the design form back from you.

What normally happens is there is a few revisions then when you’re happy we launch the site.

We deliver 5 concepts plus 5 revisions of the chosen concept.

Then we create the site and aim to have this done within 14 days.

Then once you’re happy and all the content is loaded we launch the site. You may need to provide us with content and images if you don’t pay us to make them.
Indemnification
You agree to indemnify us, our contractors and respective directors, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the our services, including but not limited to your violation of this Agreement.

Published Content
You may pay for a service from us which requires us to publish content. This could be an seo service, content writing, or social media. You give us full rights to publish content online on behalf of you and/or your company.

While we agree to only publish content that we feel will be beneficial to your business and website sometimes it might not be what you want. In instance like this you can ask for a revision. There are many reasons why you should check content before it goes live or if you want us to make your content live before you check it then you should check it when live. Reasons why it should be checked could include reasons such as regulated industries where we are not 100% sure of the guidelines.
